Is that a direct quote? I mostly read EULAs, contrary
to most people, but I don't remember this wholesale
clause from any OS X upgrade on the MacBook I have now
stopped using out of disgust for Apple's legal actions.
I remember it as being restricted to system software
files only, and that is not as much of a problem for me.
If your quote is what they really said, it's a lot worse
than I was aware of.

I did a search of the latest Mountain Lion licence agreement listed on their
website and did not find this clause in the pdf document (vs 10.8.2).
I also did a search of the MS Windows 7 home edition and did not find the clause
as written here on that pdf either.
I'm no MS or Apple fanboi, quite the opposit in fact, and don't trust either of
them as far as i can throw them. However, i would like to see a source listed on
their webiste, or perhaps a pic of the agreement you have recieved to back the
