The act says if a reasonable search doesn't find the owner it's orphaned, this
is why photographers are so aggrieved as there are no simple was to conduct a
diligent search for a photograph's owner.
Personally I would be in favour of a system that allowed my to obtain out of
print books more easily, but there has to be a pretty rigorous system of checks
involved. The author, photographer, artist, whoever has to be able to control
their works and be paid appropriately (I declare an interest I'd like to be paid
when people pinch my poetry!). Also anyone publishing material would have to be
required to keep detailed copyright information on all their output. And anyone
publishing orphaned works should have to pay an appropriate sum into a safe
account, this sum should be set at rather above the typical remuneration for
such work to encourage users to search hard!
