Circuit Court appellate judges do not censure District Court judges. They can
overrule the District Court judge's rulings, and tell her that she was wrong,
and then either make a new final ruling themselves or remand the case back to
the District Court with instructions on correcting what was done incorrectly the
first time around. Appellate Court judges do not have the authority to punish a
District Court judge in any way. The only ones that can do anything to a
standing federal judge is the legislature. Censure has no standing in the
constitution and is only a signal of disapproval without any actual
consequences. Impeachment is the only action that has constitutional standing
and the only action that can remove a sitting federal judge from the bench.[ Reply to This | Parent | # ]
