The one trouble with the free market regulation is that the little guy now has
limited recourse. In the case of bad service they can switch companies and
products as long as there is not a monopoly or penalties to switching (fees or
other means of customer lock in). When the little guy suffers a loss (property,
income, life, health...) then it is very hard to get recourse when the big
company lawyers show up.
It becomes a David and Goliath, and unlike the story David rarely wins.
It is hard to prove who's tobacco caused the cancer, another brand, second hand
smoke,...
Industrial toxins are everywhere now, did the cadmium come from the batteries,
or car tires, or food?
Asbestos was once used in so many products is still being distributed, even
after the links to cancer have been demonstrated. The people affected are now
mostly dead without a settlement.
Does a class action make them whole again, or do they drag on for so long that
the lawyers are the ones you make the money while the victims die.
