I've really gotta wonder. If Apple had actually entered good-faith
negotiations with Samsung then all their other negotiations would be unknown and
Apple could potentially negotiate a lower rate with Samsung.
However -
it's mind-boggling to think that Apple thought they could initiate a Lawsuit
instead, and without disclosing anything (even though the Lawyers were fully
aware of the discovery phase of lawsuits) manage to get a Judge to rule on an
amount "$1 or less per unit".
It would be truly ironic if the case
ends up with the Judge ruling:
Given all the factors available, a FRAND rate
offered by Samsung of 2.4% is not only reasonable, but below the common ranges
that enter negotiations. I rule Samsung is fully within appropriate ranges and
the negotiations will be entered by Apple (or they will surely face willful
infringement of copyrights) with Samsung starting negotiations at 6%.
Now
that - if it were to occur - would be so totally sweety Justice!
I think
if that were to occur, even MS would sit up and take notice.
