I'm.... assuming you're simplifying things greatly.
The other post alluded to some of the complications. Venue is a minor issue,
but related to jurisdiction (personal and subject matter). These can be tricky
issues in the United States. Especially because you also have two court
systems (well. kinda, but let's dwell on Federal v. State courts for now).
Put simply, the most common issues will be one person in a town in a dustup
with another person in a town in the United States. Every thing is easy-
Venue is the local state court.
The state court has personal jurisdiction over both.
Subject matter jurisdiction will be vested in the local court over the issue
(assuming you didn't file in probate court or something stupid, or it's a county
tribunal and it's a large dollar amount depending on state rules etc.).
Simple stuff, without getting into diversity jurisdiction of the federal courts,
or
long arm statutes, or what states a corporation is resident of etc.
But it can quickly get complicated. You usually only see this sort of extreme
forum shopping in Large Corporation v. Large Corporation type cases, and
even then you have to follow the rules closely.
Also? England's small. Real small. ;)[ Reply to This | Parent | # ]
