Thats exactly what the DMCA is all about. Dotcom contends
that he was always
in compliance with the DMCA; and in that
case its not a criminal matter.
And there are further insurmountable technicalities:
"The
Federal Rules do not contemplate service of a criminal
summons on a wholly
foreign corporation without an agent or
offices in the United States,".
... Megaupload did not have offices in the U.S. The
summons were
not properly served.

And there is the basis of the case. "Somebody" claims he violated
their copyright for financial gain (IIRC there was a threshold $75K),
and "Somebody" claims he violated DMCA. March in the lawyers,
Game On.
