That's the trouble with the analogies and the law; they
could lead you to common sense, easy-to-apply, wrong
conclusions.
The original comment posited what seemed to be a common-
sense idea; unfortunately, as far too many prisoners know,
this isn't correct. Now you have what you believe to be a
common-sense analogy, but it isn't exactly right either,
because the person hasn't turned up alive; instead, it's
more akin to "new evidence" that the murder didn't take
place, but nothing definitive. Why?
Because this isn't final action. There are still appeals of
the re-examination etc. So it's really good news for
Samsung, but not the end-all be-all, yet. And it could get
more complicated (IIRC, a finding of damages predicated on
the patent prior to invalidation will result in the damage
being upheld, although I could be wrong on that- I haven't
