Interesting...the USPTO *has* been sued for *not* allowing stupid patents.
Can it be sued *FOR* issuing "stupid" patents (that are later found to
be invalid) for redress (plus damages for negligence?) by the victim(s) of the

That does nothing but prove my point that the judicial system takes a
haphazard approach to granting patents. I'm not so much railing against the
USPTO as an institution, more against the political establishment which
allows the continuation of this broken system. It might very well be that given
the legal confines the USPTO is in it can do no better but that is the very
problem which needs to be addressed.
