Please explain what the difference is between:
Me: I program a compilable
process flow which orders salary largest to smallest and provides a sum at the
end
and
Accountant: enters a list of salaries into Excel, orders them
largest to smallest and uses the sum function in excel to provide a sum at the
end
People do not view what the account did and call the accountant a
software developer - but it's exactly the same thing with a different
tool.
So this arbitrary label that is used to try and differentiate
between developer/user does not actually change anything when it comes to what
kind of act can be viewed for patent infringement.
No patent owner will
promise not to sue users because their Lawyers know that simply programming a
programmable device is using it. To offer such a promise - and abide by
it - turns one's software patents (for purposes of infringement) into zero
value. The know that.
