"They are *not* complex, and neither Apple nor any other company
"invented" any part of them."
It is clear that Koh is not the only one that thinks smartphones are complex.
The USPTO has issued 100s of multi-touch patents to Apple alone; and 1000s of
smartphone patents besides. A device which has 1000s of patented features, and
which can be touched in 100s of distinct patented ways, is as complex as you can
get. And according to the USPTO, Apple *did invent* all these wonderfully
complex things.
So Samsung should be actually complimented for coming up with a device which
allegedly violates only 3 of these 1000s of patents. It also follows Samsung has
invented 1000s of other features which is why customers are buying their
products.
So Koh's judgment makes a lot of sense when she feels that blocking a device
which has 1000s of features, is not justified for violating just 3. To argue
otherwise would imply that the USPTO is full of incompetent people. Since as per
law, ALL the patents issued by the USPTO are deemed VALID, your argument is
voided. [ Reply to This | Parent | # ]

I must say I disagree with you on the smart phones are not complex. They are
amazingly complex, they have managed to fit a camera or two, a general purpose
computing device, a bunch of motion sensors, a radio receiver or 3 (I'm not sure
but I would guess that you need different things for wifi and cellular access,
maybe GPS and bluetooth as well), a speaker or two, maybe 3 or 4 (phone speaker,
normal speaker, possibly a second normal speaker, possibly a thing for beeps
only), a microphone, a motor (for vibrations), a touchscreen, and probably a few
other things that I missed. in a small rectangle with rounded corners that can
easily fit in your hand.[ Reply to This | Parent | # ]
