That's a great explanation on the surface. Allow me relate
an anecdote.
An attorney won a motion in front of a judge for the judge
to vacate his prior order dismissing one co-defendant in
civil litigation. On the face of the judge's order, one
might think that the plaintiff's attorney "won", since the
co-defendant was re-instated! However, this was actually a
fit of pique from the judge, who was specifically bringing
the co-defendant back in past the safe-harbor period for
Rule 11 sanctions.... oops.
So I put it to you- explain the subtle way in which Samsung
has won? I see it as not being a total loss (it's not with
prejudice)... but it's a loss. *Parties do not file motions
hoping to have them denied.*
