At first Judge Gross gave the old SCO management
plenty of rope. After they
had thoroughly tied
themselves up, he handed control to Judge Cahn.
I have no
idea why Judge Gross did this, but it
certainly wasn't out of any kindness for
the old management.
Judge Cahn fleeced the old management for a couple
of extra million. I am sure he loves them as much as
any skilled poker player
loves a mark.
The important question is: were these business records
a
threat to Judge Cahn. I am sure they are not a
threat to Judge "What are they
going to do, take me
out back and shoot me?" Gross. I cannot see Cahn letting
any ex-SCO manager near them if any evidence against him
has not already been
eaten by a wild dog. If such evidence
used to exist, there will be a court
order
authorising destruction and the ex-SCO manager will
get blamed instead
of the dog.
The only way we could could see the records is if Judge
Cahn
feels safe and Groklaw wins a bidding war against
everyone who needs secrets.
Unless IBM join the bidding,
that is not going to happen. IBM already have
their
barrel of flesh, and nothing to gain.
