A lot of the IP maximalists today seem to have the same delusion:
They
invented everything brand spanking new with nothing having come before - so they
should have absolute protection well beyond the current state of Law - but not
be held to the same standard of what came before (because nothing came
before)!
Sadly - there seem to be plenty of Lawyers willing to perpetuate
that delusion* into Courts of Law. I sure wish more Judges responded
like the Judge overseeing the Prenda
Law situation and start "putting the smack down" on the word games. In
other words: actually start sanctioning Lawyers.
While I'd like to see
that happen - I certainly don't have the wisdom to know how to draw that line so
Lawyers can feel safe for arguing situations like the Rosa Parks
situation.
* I wonder how much of that is merely
perpetuated by the Lawyers rather then initiated by same.
