The absurd thing is that just by using a difficult to understand lab
process companies like Monsanto have fooled the system into granting
them patents on products that are otherwise unpatentable. If I cross-
breed labradors and poodles to create labradoodles can I patent the
genetic code of the labradoodle? Of course not. But if create its genetic
code in a difficult to understand lab process I can suddenly patent not
only that lab process (which btw is legitimate subject matter for a
patent) but in addition can get a patent on the labradoodle's actual
genetic code and can sue for infringement whenever someone creates
a labradoodle even if he does it by natural breeding of grandkids of my
patented labradoodles even if they have already interbred with other
dogs so that I can't even know whether the dogs I'm breeding still have
the infringing DNA or may recombine to create offspring with the
infringing DNA.[ Reply to This | Parent | # ]
