But if you roll up to the silo and buy a ton of beans with the intention of
planting. They won't be marked and is there any liablity on the part of the

Well, almost. Patent marking is like
those notices on a product box that say "Patent
Pending." When you apply for a patent, you
are supposed to let the world know, so others
won't unknowingly build a business on what
will later be a patented function. Ditto when
you get a patent. You are supposed to mark
your products with the patent info, so people
know about it and thus presumably can avoid it.
There are changes in the new patent law that
I haven't absorbed yet, but that's how it has
