In my humble opinion, one change that should be applied is the recognition
that software is nothing but an abstract concept handling abstract
processes.
Even if Congress hasn't quite recognized that yet, it seems
the Supremes might be close. An article quote:
In a series of recent U.S. Supreme Court
decisions, inventions that can be characterized as an “abstract idea” or “law of
nature” have been struck down as ineligible for a
patent.
and...
And some closely-watched decisions of
the U.S. Court of Appeals for the Federal Circuit have raised questions about
the patentability of some so-called “business method” patents that are carried
out using a computer.
Here's hoping that seems to indicate the
Supremes are close to realizing anything - not just business methods - as
applied "to a computer" is nothing more then software implementing abstract
processes.
There is one sentiment in the article I find
amusing:
Patent attorneys expect some clarification regarding the
patentability of such inventions in 2013 as final decisions are rendered in
these cases.
I highly doubt patent attorneys like Gene Quinn want
clarification that "software is abstract, never is anything but, and is
therefore not patentable - period, full stop, end of line".
:)

Wish there was more context in print form.
I'm curious about what
"fact" so many are mistaken but going to the link provides no more then the
context in the news pick.
He could be talking about the US Flag on the
moon or what the average number of gophers on a golf course are.
I take
it there's an embedded film of some type?
