youtube should have recognized the upload as fair use and those that requested
it's removal should have also known as much.
As a result of knowingly making a false accusations of DMCA violation, the
complainer should have been punished by the DMCA itself (for making this false
claim of violation).
The question is why is there no application of the DMCA penalties in law against
