The whole point of the EU is to make sure that goods and services can be bought
form any member state by members of other EU state. Apple came unstuck on that

I have no doubt that many of the restrictions in MS and Apple EULA's would not
stand up to legal scrutiny. Until they have such scrutiny, though, the EULA's
will continue to be a defacto norm... or until FOSS overtakes them.
