Has anyone considered creating a website where it's not possible to not violate
the terms of service? For example, what if the TOS require prior written
permission before connecting to port 80? What would happen if the new CFAA is
passed and someone visited such a website?
What if the TOS require you to install some scum ware? Would it then be legal to
use an exploit to install my scum ware on your computer? After all, it would
prevent you from committing a felony.
What if your TOS explicitly forbade downloading or attempting to download
robots.txt files? Would Google, MS, et al then be in violation of the CFAA?
Could they get the corporate death penalty for that? What if you were forbidden
