the arithmetic mean is the correct calculation of the payoff (like with lottery
tickets). From the description the median will lie below the mean (i.e.
<$100) and I would guess the mode(the most likely return) will be 0. Just
like a lottery.
de minimis non curat lex ... on the basis of the stats perhaps courts should
refuse all patent disputes? But the US has a $20 limit on jury trials ... it
would be a near thing.
If the USPTO made the application fee over $100/claim (so a patent with 40
included claims was over $4000) that should settle the matter in a sane world.
But here patents are being acquired 'for defensive purposes - so it is not a
sane world. And many noisy people have a hope that they will have an idea (see
light bulb over head)that will make them incedibly rich (see lottery winning
