The system is supposed to see who it would cause the most
irreparable harm to, and then rule to prevent the largest. In
this case there is no real irreparable harm to apple, just an
imaginary one, however there is a very real and very large

The courts are mostly left alone by big business in the UK because if you try
these sorts of plays in a UK court you will most likely find yourself roundly
spanked.
Cf. Apples non-apology apology, and the judges public statements about lack of
integrity.

Are you saying that Apple launched this law suit knowing full well that the
patents would eventually be found invalid? If so, then they could be found to be
"vexatious" litigants, and Samsung's attorneys fees, plus all costs,
