Whilst your point may be true, you would have to spend a loat of dosh proving
that point. Money that you might not have.
It is no wonder that companies take the easy way out.
ergo, pay up and save yourself from going bankrupt.
When you buy something do you get a list of all the patents that your shiny new
widget are properly licensed for? No you don't so how can you be expected to
know if said widget is licensed or not when a Troll comes a calling? There are
so many patents (Especially wrt Mobile technology) the list could be bigger than
the phone itself.

And all software is licensed NOT bought (as MS and others love to tell you) so
why are the licensors and not the final end users not being sued as they have
