If Motorola wanted serious negotiations they should have asked for a serious
licensing price.
For instance 10 million dollars a year.
That is still a lot higher than other FRAND promising patent holders for
AVC/h.264 are getting but at least it is not a joke.
That Motorola has now lost several court cases and is under investigation from
the EU for their patent abuse should be enough clue already of how wrong they

Motorola didn't run to the courts demanding an injunction, they
just tried to
open negotiations in what used to be the ordinary course of
business in such
matters.
Er, yes they did. Motorola made a high
offer of 2.25% then after Microsoft sued for breach of contract they
counter-sued demanding an injunction.
