If Apple had negotiated for MFN status on wholesale price, I wouldn't have had a
problem. Then, they could offer books under wholesale just like Amazon, but
wouldn't affect pricing. But, to negotiate to an MFN of 30% off the lowest
retail price results in price fixing. This isn't necessarily illegal by the
manufacturers, as manufacturers have had authority to set retail prices and
policies (hence the "show low price at checkout" workarounds). But
once Apple instigates with multiple book manufacturers to change their pricing
models, it sounds like an antitrust issue to this layman.
