The line of distinction is that "good FUD" stops just short of
actually lying. It relies on suggestions and references to rumors. Those rumors
may be outright lies, but they are lies from others.
Fraud is "Your puppy will die if you use Linux."
FUD would be "Your puppy might die if you use Linux, or it might not. The
well-being of your puppy might be entirely unrelated to your choice of operating
system, in fact some scientists claim that there couldn't possibly be a
connection, but why take the chance? Don't you love your puppy? Linux kernel
developers say that the effect of Linux on puppies have never been a priority in
their code development process. We love puppies, and we prefer not to use
Linux."
Note the lack of outright lies, but the strong suggestion that using Linux might
kill your puppy.
In the legal sense, I suppose strong implications could constitute fraud, but
the devil is in the details.
