They have to. Failure to do so would be condoning
the failure of Microsoft to comply. Setting up an
estoppel situation if Google does not force the issue.
Which is exactly why Microsoft has intentionally
failed to comply entirely. They are baiting Google.
Again, the simple solution is just to block the app
from functioning, as that does not rely upon Microsoft
doing anything at all.
Better yet, instead of completely blocking the app,
redirect any fetches to a static page the contains
a copy of the Cease and Desist order so that the
end-user can see exactly what is going on.
Let the end-users complain to Microsoft.
It will be funny to watch Microsoft complain about unreasonable EULAs.
