If you had been paying attention, you would have noticed that Motorola is not
beating patents about finger gestures and rounded corners over Microsoft's and
Apple's heads.
Analogy: The Wild West: Everybody has guns. It's dangerous, and people get hurt.
However, if everybody walks around with them, you better have one too, or you
might be in big trouble when a bully comes and threatens to shoot you if you
don't hand over your money.
However, you don't go around threating other people with your gun unless you
have to discourage them from coming after you.
Yes, motorola's patents should also be invalid.

Yes, technically Motorola filed their lawsuit first. But they only did so

When parties are in negotiations, and the
talks break down, you see both parties
filing
a complaint as quickly as possible, to try
to get the case heard where
they would prefer
to be. Both parties filed in October, so while
Motorola was first to
file, Apple was filing too,
and this is quite normal. The both knew it
was
inevitable, because Apple refused to pay more than
$1.00, and that was
unacceptable to Motorola. This
was also prior to Google buying Motorola, by the
way.
