and David Boies was specifically named in the hiring agreement to be available for court appearances

That was the original deal:

David Boies will make himself available to handle critical hearings and depositions and, if applicable, at trial.

When The SCO Group and Boies Schiller renegotiated their deal and "capped" their legal fees, that provision was removed from the agreement. So Boies is no longer obligated to appear.

I think the parent means that SCO may hope that Boies, Schiller might be willing
to them to get out of the contract forcing them to work pro bono, and this new
court action puts more pressure on them to do so.

That's why IBM is happy for this to proceed - It amounts to
punishing BS&F et al. The Nazgul like to salt the earth of
their enemies.

It's advertises "Don't Mess With IBM" for every BS&F wannabe.
