to make them realise that closing that "bug" as you call it, will make
the software patent situation WORSE, not better!
Currently case law says that adding an un-patentable item to a patent-exhausted
item does not create a new patentable item.
Any attempt to fix this "bug" will overturn that precedent. The
consequences will be horrendous.
So we face a simple dichotomy, imho. Either the lawyers are handed my scenario
on a plate, which will destroy software patents, or your "bugfix" will
legalise patents on abstract ideas.
We just need to make sure that the lawyers who draw this up realise that any
attempt to "muddle through" will be a disaster, and will hand victory
to the trolls on a silver platter. If your scenario is right, well, we can kiss
any real patent reform good-bye ...
