Yes I allow cookies. I purge all except "favorites" (includes
Groklaw)
on logout, but haven't done that yet.
Desktop: MacOS 10.6.8, Safari 5.1.7
Mobile: Huawei G300 WVGA, Android 4.0.3, Boat browser 5.6, with

It seems that it is only if you choose the "Grokporate" theme that the
"theme" cookie is actually sent. So if you choose any other theme it
will not be remembered, but if you choose "Grokporate" there is no way
to get rid of it (short of using the browsers build-in cookie management
features).
But it seems that it is only the "Woodlands2" and "Mobile"
themes that are real Groklaw themes (not just sample themes included with the
cms). The browser could be instructed to choose between those automatically
using media-querys (no javascript required), so the very prominent
theme-selector-widget aren't really needed. Have a look for "responsive
design".
And you really should remove the "wrap=physical"-attribute from the
comment-textarea, so comments aren't hard-wrapped when displayed.

you may want to consider two types of
themes, a layout theme and a color theme,
and you pick one from each category.
You could default the color based on
the layout theme so it could appear as
it always has.
I am still using original Woodlands,
and can make it work on any device without
any real difficulty, so please, don't break that one. ;-)
