The FISC maintains this operational secrecy because, unlike any
other court, its “entire docket relates to the collection of foreign
intelligence by the federal government. But they're deliberately
collecting phone information between US citizens. The defense that the "entire
docket" is about foreign intelligence doesn't hold water. The only way phone
calls between US citizens who do not call abroad are a matter for "foreign
intelligence" is if you assume some sort of six-degrees-of-separation argument
where the person may call someone who calls someone who calls abroad.
But
then, where are the boundaries? Doesn't that put pretty much everything in this
court's purview?

The whole FISA thingy looks like:

/Star_Chamber
The US seems to have become the personification of the
state they once declared independence upon.

For those like myself who got confused:
FISA = Foreign Intelligence
Surveillance Act (US government)
FISC = Foreign Intelligence
Surveillance Court

"What right did they have?"
"Catch-22. [...] Catch-22 says they have a right to do
anything we can't stop them from doing. [...] What
does it mean, Catch-22? What is Catch-22?"
"Didn't they show it to you?" Yossarian demanded,
stamping about in anger and distress. "Didn't you even make
them read it?"
"They don't have to show us Catch-22," the old woman
answered. "The law says they don't have to."
"What law says they don't have to?"
"Catch-22." [...]

The shameful secret that has to be kept is for all the $zillions
spent
trawling everybody's stuff they pretend that it's beneath their station
to
catch the guys they can see in plain daylight
flogging used iTunes accounts for $5, who do more damage to the US
economy every day than all the terrorists caught so far.

Mike Gerwitz has put together a nice page summarizing the recent NSA-related
leaks and putting them in the proper context:
National Uproar: A Comprehensive Overview of
the NSA Leaks and Revelations
Its a good read, and a timely reminder of
some of the unfortunate things the American government has been doing without
the awareness or informed consent of its population. [ Reply to This | # ]
