Obviously a marble a marble
statue is harder then flesh. So that couldn't have been the definition you
meant. As an adverb:
With a great deal of effort.
And that speaks to
level of difficulty. What others might view in the saying "sweat of the brow".
And just because you'd like to redirect that as novelty/non-obvious doesn't
alter "hardness" speaks to "difficulty".
Unless you're attempting to
change the language. The Supremes spoke to that - changing language - too
mentioning something along the lines that the "draftsmans art shouldn't be
sufficient to turn a non-patent-eligible item into patent-eligible". My
paraphrasing of course.
