Prevented? Let's see what the Judge does first

In the past decade, there's been way too many Judges who weighed the two sides arguments equally and split the difference.

Even Judge Wells early on gave SCOg the benefit of doubt. She mentioned once that SCOg had acted in good faith and SCOg milked that over many other situations which I'm sure Judge Wells didn't appreciate. I certainly wouldn't appreciate my words being thrown back at me when I spoke to a specific incident and the individual took for granted I viewed other of their behavior along the same lines.

So - while I hope the Judge actually reviews the existing record relative to the differences between the IBM and SCOg perspectives - I'll wait to see how the ruling goes first.
