That's like saying it is not in the job description of a screw driver to turn
screws but rather to transfer torque. So a screw driver that has a sharp tip
shearing off all screw heads is doing its job better than a blunt one since the
torque goes all the way through the material.
The screw driver might feel like doing its job particularly well the more screw
heads it turns off. It would not have been given pressure and torque if that
wasn't what was wanted from it.
But it fact, it is useless for its purpose and needs to get thrown away, or

Given that the Court can overrule the Law to some extent (part of those
checks and balances with regards ensuring the Constitution) - the Court can most
certainly exercise some measure of Justice.
